inMotion.pk Affiliate Program – Terms & Conditions

These Affiliate Program Terms & Conditions (“Agreement”) constitute a legally binding agreement between:

inMotion Technologies (Private) Limited, operating the website www.inmotion.pk (hereinafter referred to as “inMotion”, “We”, “Us”, “Our”)

AND

The person or entity registering as an Affiliate (hereinafter referred to as “Affiliate”, “You”, “Your”).

By signing up for the inMotion Affiliate Program, You agree to be bound by this Agreement.

inMotion reserves the right to modify these Terms at any time without prior notice. Continued participation in the Affiliate Program constitutes acceptance of such changes.

1. Definitions

Website: www.inmotion.pk, it’s mobile apps, and related platforms.
Affiliate: A person or entity approved to promote inMotion and earn commission.
Booking: A taxi/cab/ride booking made through inMotion using the Affiliate’s unique link or account.
Customer: A person who makes a booking through the Affiliate’s referral.
Operator/Driver: Licensed transport service provider fulfilling the ride.
Fare: Amount paid by the Customer for the ride.
Commission: Amount payable to the Affiliate for eligible completed bookings.
Agreed Pick-Up Point/Time: As per the booking details.
Cancellation Allowed Time: Time before which cancellation is free of charge.

2. Enrollment

To become an Affiliate:

You must complete the Affiliate application form with accurate and truthful information.
inMotion reserves the right to approve or reject any application at its sole discretion.
Fake identities, misleading information, or fraudulent intent will result in immediate rejection.

3. Commission & Payments

Commission is earned only after the ride is successfully completed.
For return or multi-leg trips, commission is paid after the final leg is completed.
If the fare is refunded, disputed, or unpaid, no commission will be paid.
If commission has already been paid on such bookings, it will be adjusted against future commissions.
Commission rates may be changed at any time. Bookings already made will be honored at the old rate.
Commissions are paid monthly via bank transfer or any method decided by inMotion.
inMotion may, in certain cases, convert commissions into ride credits/points usable on the platform.
All commissions are calculated in PKR (Pakistani Rupees).
Only bookings made through the Affiliate’s registered link/account are eligible. Guest bookings or other logins are not eligible.
Commissions cannot be transferred between accounts.

4. Taxation & Invoicing (Pakistan)

Affiliate earnings are treated as a referral service provided to inMotion.
If applicable, Sales Tax or other taxes under Pakistani law may apply.
Affiliates are responsible for declaring and paying their own taxes to FBR.
inMotion may operate on a self-billing basis and issue invoices on behalf of the Affiliate.
Affiliates must provide NTN/CNIC, tax status, and other information when requested.

5. Relationship of Parties

This Agreement does not create any partnership, employment, agency, or joint venture.

The Affiliate is an independent contractor and has no authority to bind inMotion in any manner.

6. Affiliate Responsibilities

The Affiliate agrees:

To promote inMotion through lawful means only.
Not to use spam, misleading ads, fake traffic, bots, or fraudulent methods.
To comply with all applicable Pakistani laws, PEMRA rules, PTA rules, and digital marketing regulations.
Not to misrepresent inMotion’s services, pricing, or policies.

7. Limitation of Liability

inMotion shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill.

The maximum liability of inMotion under this Agreement shall not exceed the total commission payable to the Affiliate.

8. Indemnification

The Affiliate agrees to indemnify and hold inMotion harmless against any claims, losses, damages, or legal expenses arising from:

The Affiliate’s marketing practices
Violation of laws
Breach of this Agreement

9. Termination

inMotion may terminate this Agreement:

At its sole business discretion
If the Affiliate violates any terms
Upon fraudulent activity
Upon insolvency or change of control of the Affiliate

Upon termination for breach, no further commission will be payable.

10. Assignment

The Affiliate may not assign this Agreement without written consent from inMotion.

inMotion may assign or transfer its rights under this Agreement without notice.

11. Modification

inMotion may modify these Terms at any time by updating the website.

Continued participation means acceptance of the revised Terms.

12. Communications

All communications may be made electronically and shall be deemed legally valid.

13. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of Islamic Republic of Pakistan.

Any disputes shall fall under the exclusive jurisdiction of the courts of Faisalabad, Pakistan.

14. Acceptance

By registering as an Affiliate on inMotion.pk, You acknowledge that You have read, understood, and agreed to these Terms & Conditions.
